Feb. 13, 2025: Though the Social media forum and pages are flooded with hue and cry due to imposition of President’s Rule in the state of Manipur, there are certain clauses (under Clause 1 of Article 365), if allows by the Governor of Manipur, the CM may continue as Caretaker CM (with no real power) to oversee day-to-day administration to ensure continuity in governance without legislative power. However, the caretake CM cannot make major policy decisions or introduce new schemes.
The Caretaker CM, under the Governor’s control, also cannot make major decisions, pass laws, or introduce policies until a new government is formed or elected.
Meanwhile, according to reliable sources, the chances are high of N Biren Singh going to New Delhi tomorrow, and two retired IAS officers may be appointed as advisors to the Caretaker by tomorrow itself.
And it has also been reported in some sections of the media that the state assembly has been placed under ‘Suspended Animation’ and full-fledged PR has not been imposed, as the state assembly is also yet to be dissolved, which means the same government can revive without a fresh election.
And Under 365 (1), if the assembly is in ‘Suspended Animation,’ the elected MLAs technically remain as MLAs but without legislative powers, and they cannot make policy decisions or pass laws, but they can still act as public representatives. However, MLAs will have ‘no power’ if the assembly is dissolved; their roles as MLAs effectively end until fresh elections are held.
During the imposition, the Governor exercises more control over the caretaker CM’s decisions which means any important matter usually requires approval from the Governor, No Major Policy or Financial Decision, cannot announce new projects, policies, or financial allocations, only routine expenditures and previously approved projects can continue. And the role would be mainly ceremonial, ensuring a smooth transition to a new government, and he cannot influence elections or use government resources for political gains.
